Foreigners and foreign companies can own property in Kenya. Non-citizens can only hold land for a period of 99 years under a leasehold tenure.
A non-citizen cannot hold freehold property. With a freehold title you own the land for life, whereas with the leasehold title you lease the land for 99 years. The market value of a new 99 year leasehold or freehold property is usually the same.
The stamp duty value is 4 per cent of the property cost in urban areas and 2 per cent of the property cost in rural areas
